Agreement to Terms
YOUR USE OF THE SERVICES INCLUDES AGREEMENT TO BINDING ARBITRATION, A WAIVER OF CLASS ACTION RIGHTS, LIMITATIONS OF LIABILITY, AND INDEMNIFICATION OBLIGATIONS.
These provisions affect your legal rights. Please read these Terms carefully before using the Services or making any purchases.

Eligibility
The Services are intended for individuals 18 years of age or older. By using the Services, you represent and warrant that you meet this requirement.
United States–Based Services
Desolate Health operates from the United States. The Services are not intended to subject Desolate Health to the laws or jurisdiction of any non-U.S. territory. Users accessing the Services from outside the U.S. do so at their own initiative and are responsible for compliance with applicable local laws.
By submitting information through the Services, you consent to the transfer and processing of data in the United States.
License and Permitted Use
Subject to compliance with these Terms, Desolate Health grants you a limited, non-exclusive, non-transferable, revocable license to access and view the Services for personal, non-commercial use only.
Nothing in these Terms grants you the right to represent yourself as affiliated with or authorized by Desolate Health.
All Content—including text, design, graphics, videos, trademarks, logos, and other materials—remains the exclusive property of Desolate Health or its licensors.
You may not reproduce, distribute, modify, publicly display, or otherwise exploit any Content except as expressly permitted by these Terms.
Trademarks and Protected Identity
All trademarks, service marks, trade names, logos, and branding elements used on the Services are the property of Desolate Health or their respective owners.
The name, image, voice, likeness, and persona of Adam Saucerman, M.D. (the “Protected Identity”) are protected by applicable intellectual property, publicity, and unfair competition laws.
You may not use, imitate, or create derivative works involving the Protected Identity for commercial, promotional, endorsement, or misleading purposes. Unauthorized use constitutes a material breach of these Terms.

Desolate Health reserves the right to suspend or terminate access for violations of these Terms.
Accounts and Security
Certain features may require account registration. You are responsible for maintaining the confidentiality of your login credentials and all activity occurring under your account.
You agree to provide accurate, current information and to notify us of any unauthorized use. Desolate Health may suspend or terminate accounts at its discretion.
No Endorsement of Health Care Providers
The Services may include content contributed by healthcare professionals. Such contributors are not agents or employees of Desolate Health. Inclusion of their content does not constitute endorsement, and Desolate Health assumes no responsibility for relationships between users and third-party providers.
Memberships and Payments
Certain Services may require payment or subscription. All fees are due in advance and are non-refundable, except as required by law.
Desolate Health may modify pricing, content availability, or features at any time.
Disclaimers and Limitation of Liability
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND.
TO THE FULLEST EXTENT PERMITTED BY LAW, DESOLATE HEALTH DISCLAIMS ALL WARRANTIES AND SHALL NOT BE LIABLE FOR ANY DIRECT OR INDIRECT DAMAGES ARISING FROM YOUR USE OF THE SERVICES.
Your sole remedy is to discontinue use.
Arbitration and Governing Law
Any dispute arising from these Terms shall be resolved by binding arbitration administered by the American Arbitration Association. Arbitration will take place in Texas.
These Terms are governed by the laws of the State of Texas.
No Class Actions
You agree to bring claims only in your individual capacity and not as part of any class or representative action.
